Ehdot ovat voimassa 1.1.2023 alkaen toistaiseksi.

Näitä myynti- ja tilausehtoja noudatetaan Yrityksen ja Asiakkaan välillä. Näitä ehtoja sovelletaan Yrityksen tarjoamiin yksityisille tarkoitettuihin verkkokursseihin/-paketteihin sekä online-livetunteihin. Palveluita tarjotaan Suomessa. Lisäksi digitaalisia tuotteita tarjotaan Suomen rajojen ulkopuolelle.

Pidätämme oikeuden ehtojen muokkaamiseen ja päivittämiseen. Asiakkaana sinulla on vastuu tarkistaa aina osto- ja tilausehdot ennen tilauksen vahvistamista. Asiakas hyväksyy ehdot aina ennen ostamista ja sitoutuu noudattamaan niitä. Asiakas on itse vastuussa ostamiensa palveluiden kustannuksista ja käyttömaksuista.

Käyttämällä tätä verkkosivustoa (Yoga Shantiha Tmi / y-tunnus 3334631-5) sitoudut noudattamaan näitä palvelun sekä verkkosivujen käyttöehtoja, kaikkia soveltuvia lakeja ja määräyksiä ja hyväksyt, että olet vastuussa kaikkien sovellettavien paikallisten lakien noudattamisesta. Jos et hyväksy jotakin näistä ehdoista, et voi käyttää tätä sivustoa ja palveluita. Tämän verkkosivuston materiaalit ovat soveltuvan tekijänoikeus- ja tavaramerkkilain suojaamia.

Ehdot ja immateriaalioikeudet
Yoga Shantihan verkkosivuilla, kurssialustalla ja verkkokaupassa olevien materiaalien käyttö on sallittu vain henkilökohtaiseen, ei-kaupalliseen, tilapäiseen katseluun.

Palvelun sisältämän aineiston omistusoikeus, tekijänoikeus, tavaramerkki- ja kaikki muut immateriaalioikeudet kuuluvat Yoga Shantihalle ellei toisin ole ilmoitettu. Aineiston tai sen osan lainaaminen, kopiointi, tallentaminen, muokkaaminen, muuntelu, siirtäminen, luovuttaminen, muu hyväksikäyttäminen tai hyödyntäminen edes osittain ilman Yrityksen antamaa kirjallista lupaa on ehdottomasti kielletty.

Palvelun käyttäjän tulee olla täysi-ikäinen.

Asiakas on itse vastuussa omien järjestelmiensä ja laitteidensa toimivuudesta sekä suojauksesta. Palveluiden käyttäminen edellyttää toimivaa internetyhteyttä sekä tietokonetta toimivalla selaimella. Asiakas huolehtii omasta tietoturvastaan, ja on velvollinen ilmoittamaan välittömästi Toimittajalle, mikäli asiakkaan kurssialustan (alustan, jolla harjoitukset / tuntipaketit jne. julkaistaan) käyttäjätunnukset ja salasanat ovat joutuneet vääriin käsiin. Yoga Shantiha ei vastaa kolmansien osapuolien (Etsy, NewZenler, Holvi, Google, Zoom, Edenred, ePassi, Smartum) tietoturvasta ja -suojasta.

Vastuuvapaus
Asiakas sitoutuu ostamaan verkkosivuilla tarjottavia tuotteita ja palveluita omalla vastuullaan. Yoga Shantiha ei ole missään tapauksessa vastuussa mistään välillisistä eikä välittömistä vahingoista (mukaan lukien rajoituksetta tietojen tai voiton menetyksestä tai liiketoiminnan keskeytymisestä johtuvat vahingot, terveydentilan vaikutukset).

Yoga Shantiha ei vastaa vahingoista, jotka aiheutuvat force majeure -tilanteista. Tällaisia tilanteita voivat olla muun muassa ennalta-arvaamattomat tilanteen tai olosuhteet, joihin ei ole voinut varautua. Toimittaja ei myöskään vastaa pienistä vioista tai puutteista palvelussa, tai ole vastuussa kolmannen osapuolen järjestelmien toimivuudesta.

Toimittaja ei ole velvollinen vakuuttamaan asiakkaitaan, vaan jokainen asiakas huolehtii omista vakuutuksistaan osallistuessaan tunneille sekä kursseille. Asiakas on itse vastuussaan omasta terveydentilastaan ja konsultoiden aina ensin omaa lääkäriään. Toimittaja ei ole lääkäri, eikä terveydenalan ammattilainen eikä anna lääketieteellisiä ohjeita tai neuvoja.

Tilaaminen, hinnat ja maksuehdot
Yoga Shantiha toimii jooga- ja hyvinvointipalveluita tuottavana yrityksenä. Palveluita myydään sekä yksityisille henkilöille verkkokaupan välityksellä sillä hetkellä voimassa olevalla hinnalla, joka on ilmoitettu verkkokaupassa. Yoga Shantihalla on oikeus muuttaa palveluiden toimitusehtoja sekä hintoja. Verkkokaupassa olevat hinnat sisältävät Suomen arvonlisäverokannan mukaiset verot (10 % tai 24 % riippuen tarjotusta palvelusta).

Maksuvaihtoehtoina sinulla on turvallisessa Holvi.com-palvelussa Suomessa toimivat verkkopankit sekä yleisimmät pankki- ja luottokortit. Mikäli maksu halutaan suorittaa laskulla, tuotetaan lasku Holvi.com-palvelussa. Laskua varten tarvittavat tiedot ovat nimi ja sähköpostiosoite. Lasku toimitetaan sähköpostitse PDF-muodossa. Ostaja lisätään kurssialustalle (alusta, jossa harjoitukset, paketit, online-livetunnit julkaistaan), kun maksusuoritus näkyy Yoga Shantihan pankkipalvelussa. Lisäksi voit maksaa Edenredin, Smartumin tai ePassin mobiilisovelluksilla. Palveluiden tietosuojan löydät toimittajien omilta sivuilta. Yoga Shantiha ei ole vastuussa Edenredin, Smartumin eikä ePassin toiminnasta eikä tietosuojasta.Mikäli haluat maksaa liikuntaedulla, olethan aina ensin yhteydessä Yoga Shantihaan ohjeiden saamiseksi.

Suomen rajojen ulkopuolelta tulevissa ostoissa käytössä on Etsy-verkkokauppa, jossa käytössä heidän palvelun mukaiset maksuvaihtoehdot. Yoga Shantiha ei voi vaikuttaa etsyn tarjoamiin maksuvaihtoehtoihin.

Mikäli Asiakas haluaa maksaa kurssin/harjoituspaketin laskulla, tulee lähettää kurssitilaus osoitteeseen yogashantiha (at) gmail.com. [Vaihda (at) kohtaan @.] Viestissä tulee ilmoittaa Asiakkaan koko nimi sekä kurssi/harjoituspaketti, jolle ilmoittautuminen tehdään. Yritys lähettää Asiakkaalle laskun muutaman päivän sisällä viestin saapumisesta. (Yritys pidättää oikeuden lyhempään tai pidempään aikaan.) Asiakkaan suoritettua maksun kurssista/harjoituspaketista ja maksusuorituksen näkyessä Yrittäjän laskutuspalvelussa, lisätään Asiakas muutaman päivän sisällä kurssialustalle. (Yritys pidättää oikeuden lyhyempään tai pidempään aikaan.) Online-livetunteja ei ole mahdollista maksaa laskulla.

Asiakas hyväksyy tietosuojaehdot sekä tilaus- ja toimitusehdot ostotapahtumaa tehdessä.

Kurssien/harjoituspakettien ostaminen
Kurssit/harjoituspaketit ostetaan joko Yoga Shantihan verkkokaupasta (holvi.com) tai Yrityksen kotisivuilta. Tilaus aloitetaan valitsemalla haluttu kurssi/harjoituspaketti. Jokainen palvelu ostetaan palvelukohtaisesti klikkaamalla palvelun kohdalla "Tilaa"-painiketta. Sivu ohjaa sinut automaattisesti kurssien/harjoituspakettien ostosivulle (Holvi), mikäli olet valitsemassa kurssia Yrityksen verkkosivujen kautta. Asiakas lisää palvelun ostoskoriin ja suorittaa ostotoimenpiteen loppuun samalla hyväksyen tietosuojaselosteen sekä tilaus- ja toimitusehdot. Ostossa tulee käyttää toimivaa sähköpostiosoitetta, jota käytetään ostetun palvelun infotietojen sekä kirjautumistietojen lähettämiseen Asiakkaalle.

Asiakkaan ostettua kurssin/harjoituspaketin, ja Yrityksen saadessa tiedon asiakkaan ostosta, pyritään Asiakas lisäämään alustalle 48 tunnin sisällä saadusta maksusuorituksesta (Yritys pidättää oikeuden lyhempään tai pidempään aikaan). Asiakkaalle toimitetaan sähköpostilla ohjeet alustalle kirjautumisesta/rekisteröitymisestä (alustana toimii NewZenler Asiakkaan ilmoittamaan sähköpostiin). Verkkokurssit/harjoituspaketit ovat henkilökohtaisia, eikä alustan tunnuksia tai materiaaleja saa luovuttaa eteenpäin.

Kurssit/harjoituspaketit ovat voimassa 3 kuukautta siitä hetkestä kun Yritys on lisännyt Asiakkaan alustalle.

Online-livetuntien ostaminen
Online-livetunnit tilataan joko Yoga Shantihan verkkokaupasta (holvi.com) tai Yrityksen kotisivuilta. Tilaus aloitetaan valitsemalla halutun päivämäärän online-livetunti (Livetunti xx.xx.2023) ja klikkaamalla "Tilaa"-painiketta. Sivu ohjaa sinut automaattisesti online-livetuntien ostosivulle (Holvi), mikäli olet valitsemassa livetuntia Yrityksen verkkosivujen kautta. Asiakas lisää halutun päivämäärän online-livetunnin ostoskoriin ja suorittaa ostotoimenpiteen loppuun samalla hyväksyen tietosuojaselosteen sekä tilaus- ja toimitusehdot. Ostossa tulee käyttää toimivaa sähköpostiosoitetta, jota käytetään online-livetunnin linkin ja informaation lähettämiseen Asiakkaalle.

Asiakkaan ostettua kertakortin online-livetunnille, ja Yrityksen saadessa tiedon asiakkaan ostosta, saa Asiakas linkin livetunnille 15–30 minuuttia ennen tunnin alkua ilmoittamaansa sähköpostiosoitteeseen. Tunnille tulee ostaa paikka viimeistään 120 minuuttia ennen online-livetunnin alkua.

Livetunnit pidetään Zoom-alustalla. Asiakkaan ei tarvitse kirjautua / rekisteröityä Zoomiin, mutta osallistuminen edellyttää Zoom-sovelluksen asentamista Asiakkaan omalle tietokoneelle. Ohjeet löytyvät täältä.

Mikäli Asiakas ei pääse osallistumaan tunnille, Yritys ei ole velvollinen palauttamaan maksua. Maksullisista online-livetunneista tarjotaan Asiakkaalle linkki tallenteeseen 48 tunnin ajaksi siitä, kun tunti Yritys on julkaissut linkin tallenteen.

Online-livetunnit järjestetään niin, että osallistujilla ei ole kamerat sekä mikrofonit päällä. Mikäli tunti joudutaan perumaan Toimittajan puolelta, pyritään järjestämään korvaava tunti mahdollisimman pian, jolle ostettu kertakortti käy maksuksi.

Digitaalisten tuotteiden ostaminen
Digitaalisia tuotteita voidaan ostaa joko Holvi-verkkokaupasta (suomalaiset Asiakkaat) tai Etsy-verkkokaupasta (kansainväliset Asiakkaat). Oston suoritettua Asiakas saa digitaalisen tuotteen itselleen heti oston suoritettua.

Peruutusoikeus
Kuluttajasuojalain (§16) mukaisesti Asiakkaalla on 14 vuorokauden peruutusoikeus ostohetkestä sähköiselle tuotteelle, mikäli Asiakas ei ole kirjautunut palveluun aloittaen palvelun käyttöä. Peruutustilanteessa maksu palautetaan Asiakkaalle hänen tililleen (tilitiedot tarvitaan Yritykselle tässä tilanteessa) mahdollisimman pian, kuitenkin viimeistään 14 vuorokauden kuluttua peruutuksesta, joka tulee tehdä kirjallisesti yrityksen sähköpostiosoitteeseen. Peruutusehto kumoutuu, kun Asiakas kirjautuu ensimmäisen kerran verkkokurssille kurssialustan kautta.

Digitaalisilla tuotteilla ei ole vaihto- ja palautusoikeutta, koska Asiakas saa tuotteen välittömästi käyttöönsä

Nämä ehdot on päivitetty 27.7.2023, ja se tarkistetaan tarpeen mukaan.

These terms and conditions are valid from January 1, 2023, until further notice.

These sales and subscription terms apply between the Company and the Customer. These terms apply to the Company's online courses/packages intended for private individuals and online live classes. Services are provided in Finland. Additionally, digital products are offered outside the borders of Finland.

We reserve the right to modify and update these terms. As a Customer, it is your responsibility to always review the purchase and subscription terms before confirming your order. By making a purchase, the Customer accepts the terms and commits to comply with them. The Customer is responsible for the costs and usage fees of the purchased services.

By using this website (Yoga Shantiha Tmi / business ID 3334631-5) and Yoga Shatiha's services, you agree to abide by these service and website terms of use, all applicable laws, and regulations, and you accept responsibility for complying with all applicable local laws. If you do not agree with any of these terms, you cannot use this site and its services. The materials on this website are protected by applicable copyright and trademark laws.

Terms and Intellectual Property Rights:
The use of materials on Yoga Shantiha's website, course platform, and online store is permitted only for personal, non-commercial, temporary viewing.

Ownership, copyright, trademark, and all other intellectual property rights of the content belong to Yoga Shantiha unless otherwise stated. Borrowing, copying, storing, modifying, altering, transferring, transmitting, exploiting, or utilizing the content or any part of it without the written permission from the Company is strictly prohibited.

The user of the service must be of legal age.

The Customer is responsible for the functionality and protection of their own systems and devices. The use of services requires a working internet connection and a computer with a functioning browser. The Customer is responsible for their own data security and is obligated to immediately inform the Supplier if their course platform (the platform on which exercises/packages, etc., are published) login credentials have been compromised. Yoga Shantiha is not responsible for the data security and protection of third-party providers (Etsy, NewZenler, Holvi, Google, Zoom, Edenred, ePassi, Smartum).

Disclaimer:
The Customer agrees to purchase the products and services offered on the website at their own risk. Yoga Shantiha is not liable for any indirect or direct damages (including, without limitation, loss of data or profit or business interruption, health effects).

Yoga Shantiha is not responsible for damages caused by force majeure situations. Such situations may include unforeseeable events or circumstances that could not have been anticipated. The Supplier is also not responsible for minor flaws or deficiencies in the service or the functioning of third-party systems.

The Supplier is not obligated to insure its customers. Each Customer is responsible for their own insurance when participating in classes and courses. The Customer is responsible for their own health and should always consult their own doctor first.

The Supplier is not a medical professional and does not provide medical advice or instructions.

Ordering, Prices, and Payment Terms:
Yoga Shantiha operates as a yoga and wellness services provider. Services are sold to private individuals through the online store at the currently valid price, as indicated on the website. Yoga Shantiha has the right to change the delivery terms and prices of services. The prices in the online store include the applicable Finnish value-added tax (10% or 24% depending on the service offered).

As payment options, you can use Finnish online banks and the most common bank and credit cards securely through Holvi.com. If payment is to be made by invoice, an invoice is generated in Holvi.com. The required information for the invoice is the name and email address. The invoice is delivered via email in PDF format. The Buyer is added to the course platform (the platform where exercises, packages, online live classes are published) when the payment is visible in Yoga Shantiha's banking service. Additionally, you can pay with mobile apps from Edenred, Smartum, or ePassi. Information about the privacy of the services can be found on the suppliers' websites. Yoga Shantiha is not responsible for the operations and data protection of Edenred, Smartum, or ePassi. If you want to pay with a sports voucher, always contact Yoga Shantiha first for instructions.

For international purchases, the Etsy online marketplace is used, and the payment options are in accordance with their service. Yoga Shantiha cannot influence the payment options offered by Etsy.

If the Customer wishes to pay for a course/exercise package by invoice, they must send the course order to the address yogashantiha (at) gmail.com. [Replace (at) with @.] The message should include the Customer's full name and the course/exercise package they are registering for. The Company will send an invoice to the Customer within a few days of receiving the message. (The Company reserves the right to a shorter or longer period.) After the Customer has made the payment for the course/exercise package and the payment is visible in the Company's invoicing service, the Customer will be added to the course platform within a few days. (The Company reserves the right to a shorter or longer period.) Online live classes cannot be paid by invoice.

The Customer accepts the privacy terms and order and delivery terms when making a purchase.

Purchasing Courses/Exercise Packages:
Courses/exercise packages can be purchased either from Yoga Shantiha's online store (holvi.com) or from the Company's website. The order process begins by selecting the desired course/exercise package. Each service is purchased separately by clicking the "Order" button for the service. The page will automatically redirect you to the course/exercise package checkout page (Holvi) if you are selecting a course/exercise package through the Company's website. The Customer adds the service to the shopping cart and completes the purchase, accepting the privacy policy and order and delivery terms. The purchase requires the use of a working email address, which will be used to send the Customer information and login details for the purchased service.

After the Customer has purchased the course/exercise package, and the Company has received notification of the Customer's purchase, the Company aims to add the Customer to the platform within 48 hours of receiving the payment (the Company reserves the right to a shorter or longer period). The Customer will receive instructions for logging in/registering on the platform (the platform is NewZenler, and the information is sent to the Customer's provided email address). Online courses/exercise packages are personal, and platform credentials or materials cannot be shared with others.

Courses/exercise packages are valid for 3 months from the moment the Company adds the Customer to the platform.

Purchasing Online Live Classes:
Online live classes can be ordered either from Yoga Shantiha's online store (holvi.com) or from the Company's website. The order process begins by selecting the desired date of the online live class (Live Class xx.xx.2023) and clicking the "Order" button. The page will automatically redirect you to the online live class checkout page (Holvi) if you are selecting an online live class through the Company's website. The Customer adds the desired date of the online live class to the shopping cart and completes the purchase, accepting the privacy policy and order and delivery terms. The purchase requires the use of a working email address, which will be used to send the Customer the link and information for the online live class.

After the Customer has purchased a single pass for an online live class, and the Company has received notification of the Customer's purchase, the Customer will receive the link to the live class 15–30 minutes before the class start time to the email address they provided. The Customer must secure their spot for the class no later than 120 minutes before the online live class starts.

The live classes are conducted on the Zoom platform. The Customer does not need to sign up/register for Zoom, but participation requires installing the Zoom application on the Customer's computer. Instructions can be found here.

If the Customer cannot attend the class, the Company is not obligated to refund the payment. For paid online live classes, the Customer will be offered a link to the recording for 48 hours from the time the Company publishes the recording link. Online live classes are held with participants' cameras and microphones off.

If the class needs to be canceled by the Supplier, efforts will be made to schedule a replacement class as soon as possible, and the purchased single pass will be valid for the replacement class.

Purchasing Digital Products:
Digital products can be purchased either from the Holvi online store (Finnish Customers) or the Etsy online store (international Customers).

After the purchase, the Customer receives the digital product immediately.

Right of Withdrawal:
In accordance with the Consumer Protection Act (§16), the Customer has a 14-day right of withdrawal for electronically delivered products if the Customer has not logged into the service to start using it. In the event of withdrawal, the payment will be refunded to the Customer's account (bank details will be required by the Company in this situation) as soon as possible, but no later than within 14 days of the withdrawal, which must be done in writing to the Company's email address. The right of withdrawal is waived once the Customer logs into the online course through the course platform.

Digital products cannot be exchanged or returned because the Customer gains immediate access to the product.
